Does Dynex pass the Howey Test? Legal opinion suggests that Dynex will not be deemed as a security✅
Why is this important? Because it is favourable for DNX not to be qualified as a security. The law-firm we hired performed the Howey Test on Dynex and concluded, per their legal view, DNX should not be deemed as a security per the U.S federal securities laws.
